Xplay is a network of dedicated servers for training your gaming skills (“Service”).
The Service is provided by CS Virtual Trade Ltd, a Cyprus private limited company, registration number HE 389299, having its place of business at 705, Spyrou Araouzou & Koumantarias, Fayza House, 3036, Limassol, Cyprus (“xplay”, “we,” “us,” or “our”).
You need to be of legal age to enter into the Agreement. If you are less than 18 years old (or below legal age in your jurisdiction), you need to obtain parental or legal guardian permission to enter the Agreement.
By using the Service, you declare that according to your local jurisdiction, you are of legal age and eligible to enter into the Agreement on your own or have received parental or legal guardian approval to enter into the Agreement.
Registration. To register an xplay user account (“Account”) and use the Service you must:
a) have a registered Steam account provided by Valve;
b) sign in to xplay via your Steam account;
You are solely responsible for managing and safeguarding your login credentials, maintaining confidentiality, and restricting access to your Account, as well as for all activities that occur under these credentials. It is your responsibility to ensure that your use of the Service within your Account complies with any applicable laws or regulations.
a) Refuse to register an Account
b) Suspend (block) your Account
c) Terminate your Account with immediate effect
We note that we can undertake any and all of the above actions subject to our discretion without any liability or further obligation of any kind whatsoever to you or any other party. Deletion. If you wish to terminate your account, please contact our Support team via online chat. By deleting your account, this Agreement will be terminated.
One user can only log in and complete challenges from two accounts, the rest will be banned.
While playing on our servers you must comply with the behavioral rules listed below. At any time you should refrain from:
- cheating, hacking, or scripting;
- insulting the players, deceiving/misleading others, being aggressive and intolerant;
- using language that is abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or racially, ethically, or otherwise objectionable;
- bypassing server bans using a different Steam account;
- using any software that is prohibited by Valve Corp. (developer);
- spamming, advertising any products/services, posting links;
- exploiting the features in order to dishonestly receive xcoins;
- impersonating admins or other members;
- encourage other players to break the rules or attempt to trick them into doing so;
We reserve the right to ban a User if we detect or reasonably believe that such User is in breach of these Rules.
Use of the basic features of the Service is free of charge. To access more features of the Service, you may subscribe to a paid plan on the Website (hereinafter referred to as the “Subscription”). Subscription plans are listed on the Website, as well as relevant terms, costs, and methods of purchase. We may change our subscription plans and the price of our service from time to time; however, any such changes will apply no earlier than 30 days following notice to you.
We offer free of charge trial period (“Trial period”). The conditions of the Trial Period are desplayed on the Website. Upon the expiratioin of the Trial period, the regular price for the Subscription will be charged automatically.
Should you not wish to continue the Subscription once the Trial period ends, you must cancel it in your personal settings on the Website no later than 24 hours before the Trial period ends. All customers signing up for the free trial are required to submit payment account details as part of the process, to allow automatic payments once the Trial period finishes under the Terms on the storage of the cardholder’s credentials.
We reserve the right to remove or cancel the Trial perod or to change the features of the Trial period at any time.
To purchase a Subscription, you must provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time. The available Payment Methods are listed on the Website.
Payment Methods have their own terms, policies, including AML/KYC Policies, and may decline, suspend any transactions in accordance with their own rules. Any applicable terms and policies of a respective Payment Method shall apply to the processing of payments and should be reviewed and understood by the User before making any transaction.
Xplay is not responsible for any delays in payment and/or actions of the respective payment processing service provider.
If the currency of your payment account is different from the nominated currency, your payment will be converted into the nominated currency at the time of the payment. The conversion rate of your bank will be applied. The respective charged amounts shall be indicated on the respective payment page. Xplay is not responsible in any way for the conversion rates set by the payment institutions.
By making payments, you confirm that you are the rightful owner of all bank cards and other payment accounts you use to make payments.
We guarantee the security of bank card payments. The processing center meets the international PCI DSS requirements to provide secure treatment of the player's bank card details.
By ticking the relevant tick-box and clicking the “Subscribe”(or similar) button, you express full consent to these terms on the storage of the cardholder credentials (“COF Terms”) and authorize the payment processing service provider to store your name, surname, card expiry date, and PAN number (hereinafter – the Credentials on File (COF)) and to initiate transactions on your behalf (hereinafter – Merchant-Initiated COF Transactions) and/or to process transactions initiated by you (hereinafter – Cardholder-Initiated COF Transactions), both by using the Credentials of File, as indicated below.
Upon the purchase of xplay Subscription, your Credentials will be used for automatic payments (Merchant-Initiated COF Transactions) for the applicable Subscription. Depending on the Subscrption plan the payment will be initiated each month/every 3 months/ each year on the day of your first payment. For example, if you purchased a monthly Subscription on January 15, your payments will be on the 15th day of each subsequent month (February 15, March 15, etc.) until you cancel. If you purchased a 3-month subscription on January 15, your next payment will be due on April 15, etc. If there is no corresponding date in a month, the payment will be initiated on the last day of the month. You will be notified of any changes to the COF Terms 7 (seven) business days before such changes become effective in relation to scheduled (with fixed, regular intervals) Merchant-Initiated COF Transactions.
These COF Terms shall enter into force after successful authorization (or account verification) by your card issuer and receipt of your consent to these COF Terms by xplay, and shall be valid until terminated by you or by xplay according to the Cancellation policy.
You may cancel the Subscription, and withdraw your consent to automatic payments (COF Terms) at any time by accessing your Account Settings. You will continue to have access to the Subscription through the end of your billing period. Payments are non-refundable, and we do not provide refunds for any partial membership periods or unused content (see “Refund Policy”). If payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not cancel your subscription, we may suspend your access to the Service until we have successfully charged a valid Payment Method.
Our Service is deemed to be fully performed at the time of granting you access to the additional features under Subscription, which constitute an exemption from the general withdrawal right.
BY AGREEING TO THIS REFUND POLICY AND MAKING A PURCHASE, YOU EXPRESSLY CONSENT TO THE LOSS OF YOUR RIGHT OF WITHDRAWAL AND WAIVE ANY RIGHTS IN CONNECTION THERETO.
You may request a refund for the following reasons:
The Product was not received. Please note that we start processing your purchase after your payment has been approved. Usually, it takes seconds to confirm your payment but may take up to 3 days depending on the payment method used. If you have not received the Service purchased or received not in full, please contact xplay Support team via the online chat on the Website. Once we confirm the non-delivery, we will proceed with the refund or deliver the Service by your choice.
Failure to deactivate a subscription. If you failed to deactivate your subscription 24 hours before its expiration and were charged regularly, we will provide you with a refund for the latest renewal provided that you have contacted our Customer Support within 48 hours after being charged for the subscription, provided that you haven’t used the Service in the period you request a refund for. By default, purchases will be refunded to the payment method used to make the purchase. Usually, it takes about three days, but a refund may take up to 45 days, depending on your payment method.
You can complete daily tasks - “Challenges” and earn xcoins. Xcoins are in-platform points. Xcoin - is not a currency, does not have a value outside of the platform, can not be withdrawn or exchanged for money. You can not buy xcoins for money. If you have a CS:GO Prime Status you can exchange xcoins for the digital items offered by xplay on the Website. Xplay defines the digital items available for the exchange and the terms of exchange at its sole discretion.
The xplay product or Service names, logos or slogans, the Website content, designs, translations, domain names, downloadable documents, digital conversions including, without limitation, all page headers, custom graphics, button icons, scripts, look and feel of the Website constitute the intellectual property of xplay. You must not copy, imitate, sell, license, rent, modify, distribute, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, reverse engineer, decompile, derive source code from, or create derivative works from any intellectual property of xplay. Any trademarks, logos, skins, artworks, and other objects of intellectual property (either registered or unregistered), presented on the Website belong to their respective owners. There are no implied licenses to use them unless otherwise stipulated by the owner in writing. Any unauthorized use is an infringement sanctioned by the applicable legislative framework.
We grant you a non-transferable, non-exclusive, revocable, limited license to use the Website solely to use xplay Service.
The Website and Service are provided "as is", we make no warranties, expressed or implied, and we hereby disclaim and negate all and any warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose. Further, we do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the Service.
To the extent permitted by applicable law, you shall indemnify and hold harmless xplay, its licensors, licensees, distributors, agents, representatives, and other authorized Users from and against any and all claims, damages, obligations, losses, liabilities, costs, attorney fees, and expenses arising out of or in connection with (i) your use of the Service, (ii) your violation of law and/or this Agreement and/or any other agreements, terms, and policies applicable to you, (iii) your violation of any third party right, including, but not limited to, copyright, trademark, or privacy right.
You agree to cooperate as fully as reasonably required in defense of any claim. Xplay reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. You shall not enter into any agreement that affects the rights of xplay without xplay’s prior written approval.
Neither xplay nor any other party involved in creating or delivering the Website and/or Services shall be liable for any direct, indirect, incidental, special, punitive, consequential, or exemplary damages arising out of or in connection with (i) any use of, or inability to use, the Services, the Website or (ii) the exchange, sale, purchase, or use of the virtual items. The Website may contain links to other third-party websites. We are not in any way responsible for the content of such links as these are not in any way monitored by us. We shall not be held liable and/or responsible for the content of such third-party websites and accept no liability for any loss or damages occurring as a result of or relating to the use of these websites. We note that you do so at your own risk if you access these third-party websites.
This limitation applies regardless of nature of action (whether a breach of contract or tort, including negligence) and even if xplay has previously been advised of or reasonably could have foreseen the possibility of such damage or loss. This limitation applies to all damages arising out of or in connection with any use of, or inability to use the Service or the Website, including but not limited to: (i) errors, mistakes, or inaccuracies; (ii) personal injury or property damage; (iii) any unauthorized access to or use of our secure servers, including any personal or financial information stored therein; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted through the Website or Services.
Xplay’s aggregate liability to a User in any circumstance is limited to $100. To the extent that any jurisdiction does not allow the exclusion or limitation of any incidental or consequential damages, the above limitation shall apply to the extent permissible under applicable law.
We may modify, suspend and/or discontinue the Service, Website, or Application and their content, provide new capabilities and/or features and make changes to this Agreement from time to time without prior notification. We may do this for various reasons, including changes in or requirements of the law, new features, changes in business practices, and/or any other reason. The most recent version of this Agreement will be posted on the Website, and you should regularly check for the most current version. If the changes include material changes that affect your rights or obligations, we will notify you of the changes by reasonable means through the Website or via email. If you continue to use the Service after the changes become effective, you agree to the revised Agreement.
No failure by xplay to notify you of any breach or exercise of any rights shall be deemed a waiver thereof at the same or at any prior or subsequent time.
Xplay may assign, subcontract or otherwise transfer its rights and/or obligations hereunder without notice to you or obtaining your consent. You may not assign, sub-contract, or otherwise transfer your rights and/or obligations hereunder.
If the Claim is not resolved within 60 days, the Parties may submit the dispute to the jurisdiction of the courts of the country whose laws are applicable subject to this article. Where permitted under the applicable law, you agree to bring claims against xplay only in your capacity and not as a plaintiff or class member in any purported class or representative action.
We provide 24/7 live support via the online chat located in the right bottom corner of the Website. Please address all your inquiries first to our Support team. It is forbidden to use obscene language, words, and/or expressions of an obscene, offensive nature, threats, or actions in the Support chat or the communication with xplay representatives.
