XPLAY is an online gaming platform that provides dedicated servers and related in-Service features designed to help users train, improve their gaming skills, and access other functionalities made available on the Website (the "Service").
The Service is intended for entertainment purposes only. The Service is not a gambling service, betting service, lottery, sweepstakes, raffle, game of chance, investment service, or financial product, and does not offer any opportunity to win money or prizes based on chance. By accessing or using the Service through the website https://xplay.gg/ (the"Website"), you agree to be bound by these terms and conditions of use of XPLAY Service (the "Terms of Use"), which constitute the entire legally binding agreement between you ("you" or "User") and XPLAY ("XPLAY", "we," "us," or "our"), governing your use of the Service (collectively, the "Agreement").
You need to be of legal age to enter into the Agreement. If you are less than 18 years old (or below legal age in your jurisdiction), you need to obtain parental or legal guardian permission to enter the Agreement.
By using the Service, you declare that according to your local jurisdiction, you are of legal age and eligible to enter into the Agreement on your own or have received parental or legal guardian approval to enter into the Agreement.
We care about your privacy. How your personal data is collected, used, and shared when you're using the Service is explained in our Privacy Policy and Cookie Policy. Please read them carefully.
Registration. To register an XPLAY user account ("Account") and use the Service you must:
a) have a registered Steam account provided by Valve;
b) sign in to XPLAY via your Steam account;
c) read and accept these Terms of Use, familiarize yourself with Privacy Policy and Cookie Policy.
You are solely responsible for managing and safeguarding your login credentials, maintaining confidentiality, and restricting access to your Account, as well as for all activities that occur under these credentials. It is your responsibility to ensure that your use of the Service within your Account complies with any applicable laws or regulations.
Suspension
If we determine, or reasonably believe, that you are in breach of these Terms of Use, we may, at our sole discretion and without prior notice, take any action we consider appropriate, including:
- refuse to register an Account;
- suspend (block) your Account;
- restrict your access to all or part of the Service;
- remove, reverse, cancel, or withhold any benefits, features, rewards, Xcoins, digital items, withdrawals, or other functionalities obtained through the Service; and/or
- terminate your Account with immediate effect.
We may also take any of the above actions where we are required to do so for legal, regulatory, technical, operational, security, fraud-prevention, or business reasons, or where we reasonably believe that your use of the Service may expose XPLAY, other users, or any third party to risk, harm, liability, or reputational damage.
If your Account is suspended or terminated due to your breach of these Terms of Use, abuse of the Service, fraud, chargeback abuse, multi-accounting, manipulation, or other dishonest conduct, XPLAY may, to the extent permitted by applicable law, cancel or forfeit any unused Xcoins, pending rewards, undelivered digital items, pending withdrawals, or access to paid content associated with your Account, without any obligation to compensate you.
To the extent permitted by applicable law, XPLAY shall not be liable for any refusal of registration, suspension, restriction, cancellation, withholding, or termination of your Account or access to the Service carried out in accordance with these Terms of Use.
Deletion
If you wish to delete your Account, please contact our Support team via online chat or use any account deletion functionality made available on the Website.
Deletion of your Account will result in termination of this Agreement, unless any provisions of these Terms of Use are intended by their nature to survive termination.
While playing on our servers you must comply with the behavioral rules listed below. At any time you should refrain from:
- cheating, hacking, or scripting;
- insulting the players, deceiving/misleading others, being aggressive and intolerant;
- using language that is abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or racially, ethically, or otherwise objectionable;
- bypassing server bans using a different Steam account;
- using any software that is prohibited by Valve Corp. (developer);
- spamming, advertising any products/services, posting links;
- exploiting the features in order to dishonestly receive Xcoins;
- impersonating admins or other members;
- encourage other players to break the rules or attempt to trick them into doing so.
We reserve the right to ban a User if we detect or reasonably believe that such User is in breach of these Rules.
In addition, you must not use the Service, the Website, Challenges, Premium features, BattlePass, Skinchanger, the Xcoins store, the market, or any other functionality in an abusive, fraudulent, automated, or manipulative manner, including for the purpose of unfairly obtaining Xcoins, rewards, access, digital items, or any other advantage within the Service.
Use of the basic features of the Service is free of charge. To access more features of the Service, you may subscribe to a paid plan on the Website (hereinafter referred to as the "Subscription"). Subscription plans are listed on the Website, as well as relevant terms, costs, and methods of purchase.
We may change our subscription plans and the price of our service from time to time; however, any such changes will apply no earlier than 30 days following notice to you.
Subscription may include access to certain premium features and benefits displayed on the Website from time to time, including enhanced in-Service functionality, additional content, boosts, or other benefits. The exact scope, duration, and availability of Subscription benefits are determined by XPLAY and may vary depending on the plan displayed on the Website.
Unless otherwise expressly stated on the Website for a particular plan, the Subscription remains active and automatically renews for successive billing periods until you cancel it in accordance with these Terms of Use.
Trial period
Where expressly offered on the Website, we may offer a free-of-charge trial period for a Subscription (the "Trial Period"). The availability, duration, scope, eligibility criteria, and other conditions of the Trial Period shall be as displayed on the Website at the time of the offer.
Unless you cancel the Subscription in your personal settings on the Website no later than 24 hours before the end of the Trial Period, the regular Subscription fee will be charged automatically upon expiry of the Trial Period in accordance with these Terms of Use and the Terms on the storage of the cardholder's credentials.
Using the Trial Period more than once, including through multiple Steam accounts or any other abusive, deceptive, or circumvention practice, is prohibited and may result in refusal of access to the Trial Period, suspension of the Account, or termination of the Account.
We may, at our discretion and to the extent permitted by applicable law, make the Trial Period unavailable, withdraw it, or change its duration, scope, eligibility criteria, or features at any time.
XPLAY may offer you access to additional Service functionalities available on a single-payment basis or as part of a paid plan displayed on the Website.
Such functionalities may include, among other things, BattlePass, Skinchanger, premium features, boosts, access to additional content, personal matches, pro configs, visibility-related features, and other in-Service content or functionality which may be described on the Website from time to time.
Conditions of sale of such additional Service functionalities are available on the Website.
Purchase of any paid content grants you a limited, personal, non-transferable, revocable right to access and use the relevant functionality within the Service only. It does not grant you any ownership right in the Service, the Website, any software, or any intellectual property.
We may change, replace, suspend, remove, or discontinue any paid content or any of its features at any time for legal, technical, operational, security, or business reasons.
You can complete daily tasks, missions, and other activities within the Service ("Challenges") and earn Xcoins.
Xcoins are in-platform points. Xcoins are not a currency, do not have a value outside of the platform, cannot be withdrawn or exchanged for money, and cannot be purchased for money.
Xcoins are not cryptocurrency, virtual assets, electronic money, stored value, or a payment instrument. Xcoins do not represent any ownership right, redemption right, or claim against XPLAY.
Where available on the Website, Xcoins may be used only within the Service to obtain digital items or other functionalities offered by XPLAY. XPLAY defines, at its sole discretion, the digital items, rewards, functionalities, availability, stock, and terms of exchange applicable to Xcoins.
If you have a Prime Status or any other status required on the Website, you may exchange Xcoins for the digital items offered by XPLAY on the Website, subject to the rules and limitations displayed on the Website.
You are allowed to use only 2 Steam accounts to earn Xcoins.
Using multiple (more than 2) accounts to earn Xcoins is prohibited.
If we detect or reasonably believe that a User has abused Challenges, used unauthorized software, manipulated gameplay, engaged in multi-accounting, fraud, chargeback abuse, or otherwise dishonestly obtained Xcoins, rewards, or digital items, we may, at our discretion and without prior notice, remove Xcoins, cancel rewards, reverse exchanges, block withdrawals, suspend access to certain functionalities, suspend the Account, or terminate the Account with immediate effect.
XPLAY may allow Users to obtain certain digital items made available on the Website, including through the Xcoins store, challenges, paid content, or other functionality of the Service.
Where available on the Website, digital items obtained by a User may first appear in the User's XPLAY inventory. The crediting of a digital item to the User's XPLAY inventory shall be deemed proper delivery of the relevant item by XPLAY.
Where withdrawal of a digital item is available, the User must follow the instructions displayed on the Website and provide all required information, including a valid Steam account and trade link, if applicable.
The User is solely responsible for the accuracy of the Steam account, trade link, and any other withdrawal details provided by the User. XPLAY shall not be responsible for failed, delayed, rejected, or misdirected delivery resulting from incorrect details, Steam restrictions, trade holds, privacy settings, account restrictions, technical issues of third-party platforms, or any other circumstances beyond XPLAY's reasonable control.
XPLAY does not guarantee that any particular digital item will be continuously available for obtaining, holding in inventory, or withdrawal. Digital items, stock, timing of delivery, and withdrawal options may vary and may be limited, suspended, or discontinued at any time.
If a digital item becomes unavailable before delivery for reasons beyond XPLAY's reasonable control, XPLAY may, at its discretion, provide a replacement item of comparable type or value, restore the relevant Xcoins, or issue a refund where required under the Refund Policy or applicable law.
XPLAY does not guarantee any market value, resale value, availability, tradability, or future utility of any digital item.
To purchase a Subscription or any paid content, you must provide us with one or more Payment Methods. "Payment Method" means a current, valid, accepted method of payment, as may be updated from time to time. The available Payment Methods are listed on the Website.
Payment Methods may include card payments, digital wallet payments, and, where expressly made available on the Website, certain digital asset payment methods supported by our payment processing partners. The availability of any particular Payment Method may vary by country, device, technical availability, payment provider, and other factors.
Where a digital asset payment method is made available on the Website, such payment method shall be subject to any additional terms, instructions, technical requirements, supported networks, conversion mechanics, settlement rules, wallet requirements, transaction confirmation requirements, and compliance checks communicated by the relevant payment processing provider or displayed on the Website at the time of payment. XPLAY does not provide exchange, brokerage, custody, wallet, transfer, remittance, or other regulated cryptoasset services to Users.
Payment Methods have their own terms and policies, including compliance, AML/KYC, authorization, fraud-prevention, chargeback, and settlement rules, and may decline, suspend, reverse, or otherwise refuse transactions in accordance with their own requirements. Any applicable terms and policies of the relevant Payment Method or payment processing provider shall apply to the processing of payments and should be reviewed and understood by the User before making any transaction.
XPLAY is not responsible for any delays, failures, reversals, exchange-rate fluctuations, network fees, blockchain confirmation issues, payment holds, rejected transactions, or other actions or omissions of any Payment Method, payment processing service provider, card network, digital asset network, bank, or other third party involved in the payment process.
If the currency of your payment account, wallet, or payment source is different from the nominated currency of the transaction, your payment may be converted into the nominated currency at the time of payment or settlement. The conversion rate, fees, spread, and other charges of your bank, wallet provider, payment institution, or payment processing provider may apply. The respective charged amounts shall be indicated on the relevant payment page where available. XPLAY is not responsible for exchange rates, fees, or other charges set by payment institutions or payment providers.
By making payments, you confirm that you are the rightful owner of all bank cards, wallets, accounts, and other payment sources you use to make payments, or that you are otherwise duly authorized to use them.
We use payment processing providers and commercially reasonable security measures for the processing of payments. Where card payments are used, the relevant processing environment is intended to comply with applicable PCI DSS requirements.
By ticking the relevant tick-box and clicking the "Subscribe" button (or a similar button), you agree to these terms on the storage and use of cardholder credentials ("COF Terms") and authorize the relevant payment processing service provider to store your cardholder credentials and related payment information required for recurring billing (the "Credentials on File" or "COF"), and to use such Credentials on File to process transactions as described in these COF Terms.
Upon the purchase of an XPLAY Subscription, your Credentials on File will be used to process recurring automatic payments for the applicable Subscription (Merchant-Initiated COF Transactions). Depending on the Subscription plan selected by you, the recurring payment will be initiated monthly, every 3 months, or annually on the calendar day corresponding to the date of your initial payment. For example, if you purchase a monthly Subscription on January 15, the next recurring payments will be initiated on February 15, March 15, and so on, until you cancel the Subscription. If you purchase a 3-month Subscription on January 15, the next recurring payment will be initiated on April 15. If there is no corresponding date in a given month, the recurring payment will be initiated on the last calendar day of that month.
You will be notified of any material changes to these COF Terms at least 7 (seven) business days before such changes become effective in relation to scheduled Merchant-Initiated COF Transactions, where required by applicable law or payment scheme rules.
These COF Terms shall enter into force upon your acceptance of these COF Terms and, where applicable, successful authorization or verification by your card issuer or payment processing provider, and shall remain in force until terminated by you through cancellation of the Subscription or withdrawal of your consent to recurring billing, or by XPLAY in accordance with these Terms of Use.
You may cancel the Subscription, and withdraw your consent to automatic payments (COF Terms) at any time by accessing your Account Settings. You will continue to have access to the Subscription through the end of your billing period. Payments are non-refundable, and we do not provide refunds for any partial membership periods or unused content (see "Refund Policy").
If payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not cancel your subscription, we may suspend your access to the Service until we have successfully charged a valid Payment Method.
By placing an order for a Subscription, paid content, digital items, or other digital functionality made available through the Service, you expressly request immediate supply or activation of the relevant digital content and/or digital service.
To the extent permitted by applicable law, our Service shall be deemed performed when the relevant Subscription features are activated, paid content is credited to your Account or XPLAY inventory, a digital item is credited or made available for withdrawal, or the purchased functionality is otherwise made available to you.
BY MAKING A PURCHASE, YOU ACKNOWLEDGE AND AGREE THAT, TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU MAY LOSE YOUR RIGHT OF WITHDRAWAL ONCE THE RELEVANT DIGITAL CONTENT OR DIGITAL SERVICE HAS BEEN SUPPLIED, ACTIVATED, CREDITED, OR OTHERWISE MADE AVAILABLE TO YOU.
Available refunds and how they are made
You may request a refund for the following reasons:

Please note that we start processing your purchase after your payment has been approved. Usually, it takes seconds to confirm your payment but may take up to 3 days, depending on the payment method used.
If you have not received the Service purchased or received it not in full, please contact XPLAY Support team via the online chat on the Website. Once we confirm the non-delivery, we may, at our discretion and unless applicable law requires otherwise, provide the missing product, replace it, restore the corresponding entitlement, or issue a refund.
Failure to deactivate a Subscription.
If you failed to deactivate your Subscription 24 hours before its expiration and were charged regularly, we may provide a refund for the latest renewal, provided that you have contacted our Customer Support within 48 hours after being charged for the Subscription and provided that you have not used the Service during the renewal period for which you request a refund.
No reason. Applies to BattlePass purchases only.
You may request a refund for the purchase of BattlePass within 14 days from the transaction date, provided that you have not used the BattlePass, claimed or received any BattlePass-related benefits, and your Payment Method allows refunds.
Where a refund is approved or required under applicable law, XPLAY may issue the refund to the original payment method or, where the original payment method is unavailable, unsupported, non-refundable, non-reversible, or otherwise impracticable to use, in such other form, method, currency, or payment channel as may be technically available and reasonably practicable through the relevant payment provider, unless applicable law requires otherwise.
Refund timing may vary depending on the payment method, payment processing provider, and applicable technical or regulatory limitations.
Non-refundable purchases and payment methods
No refund shall be available for Subscription periods already used, digital items already credited to your XPLAY inventory, digital items already withdrawn or transferred, or paid content already used, consumed, activated, claimed, or otherwise made available to you, except where required by applicable law.
Certain payment methods made available on the Website may, by their nature or under the rules, policies, technical limitations, or settlement mechanics of the relevant payment processing provider, bank, wallet provider, card network, digital asset network, or other third party, be non-refundable, non-reversible, or refundable only subject to specific conditions or limitations.
Where a purchase is made using a digital asset payment method or any other payment method that is non-refundable or non-reversible under the rules or technical limitations of the relevant payment provider, such purchase shall generally be treated as final and non-refundable, except where a refund is required under applicable law.
To the extent a refund is required under applicable law or is otherwise approved by XPLAY at its discretion, XPLAY may issue the refund in the amount actually received by XPLAY, in fiat currency, store credit, or such other form, method, currency, or payment channel as may be technically available and reasonably practicable through the relevant payment provider, unless applicable law requires otherwise.
XPLAY does not guarantee that any refund will be made through the same payment method, to the same wallet, through the same blockchain network, in the same currency, or in the same nominal amount originally used for the purchase.
Any trademarks, logos, skins, artworks, and other objects of intellectual property (whether registered or unregistered) presented on the Website belong to their respective owners. There are no implied licenses to use them unless otherwise stipulated by the relevant owner in writing. Any unauthorized use may constitute an infringement under applicable law.
We grant you a non-transferable, non-exclusive, revocable, limited license to use the Website solely to use the XPLAY Service in accordance with these Terms of Use.
XPLAY is an independent service and is not affiliated with, endorsed by, sponsored by, or approved by Valve Corp., Steam, Counter-Strike, or any other game publisher or platform provider, unless expressly stated otherwise.
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless XPLAY, its affiliates, licensors, service providers, contractors, agents, representatives, and personnel from and against any third-party claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
(i) your breach of these Terms of Use or any other applicable terms, rules, or policies;
(ii) your unlawful use of the Service;
(iii) your fraud, misuse, abuse, manipulation, chargeback abuse, or circumvention of any security, technical, or eligibility controls of the Service; or
(iv) your infringement of any third-party rights, including intellectual property, privacy, or other proprietary rights.
You agree to cooperate as reasonably required in the defence of any such claim. XPLAY reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, at your expense to the extent permitted by applicable law. You shall not settle any such matter in a manner that admits fault by XPLAY or imposes obligations on XPLAY without XPLAY's prior written consent.
To the fullest extent permitted by applicable law, XPLAY and any other party involved in creating, operating, maintaining, or delivering the Website or the Service shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, or for any loss of profits, revenue, business, goodwill, data, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service, the Website, paid content, digital items, or any third-party services linked to or integrated with the Service.
The Website may contain links to third-party websites, platforms, payment providers, social media channels, or other third-party resources. XPLAY does not control and is not responsible for the content, availability, policies, functionality, or practices of such third-party services. Your use of third-party services is at your own risk and subject to the terms of those third parties.
To the fullest extent permitted by applicable law, XPLAY shall not be liable for any loss or damage arising out of or in connection with:
(i) errors, interruptions, downtime, delays, bugs, or inaccuracies of the Service or Website;
(ii) unauthorized access to or use of your Account, our systems, or any information stored therein;
(iii) viruses, malware, trojan horses, or similar harmful code transmitted through the Service, Website, or third-party services;
(iv) the acts, omissions, restrictions, downtime, policies, fees, trade holds, technical limitations, or other conduct of Steam, Valve, payment providers, digital asset networks, or other third-party platforms;
(v) the exchange, availability, non-availability, withdrawal, delivery, non-delivery, transferability, or market value of digital items; or
(vi) suspension, restriction, withholding, reversal, cancellation, or termination actions taken by XPLAY in accordance with these Terms of Use.
Nothing in these Terms of Use excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.
To the extent permitted by applicable law, XPLAY's total aggregate liability to you for all claims arising out of or in connection with the Service or these Terms of Use shall not exceed the greater of:
(a) the total amount paid by you to XPLAY in the 12 months immediately preceding the event giving rise to the claim; or
(b) USD 100.
Where any jurisdiction does not allow the exclusion or limitation of certain damages or liabilities, the limitations in this section shall apply only to the extent permitted by applicable law.
Any provisions of these Terms of Use which by their nature should survive suspension, deletion, or termination of the Agreement shall survive, including without limitation provisions relating to payments, refunds, digital items, intellectual property, indemnification, limitation of liability, applicable law and jurisdiction, and any accrued rights or remedies.
We may modify, suspend and/or discontinue the Service, Website, or Application and their content, provide new capabilities and/or features and make changes to this Agreement from time to time without prior notification. We may do this for various reasons, including changes in or requirements of the law, new features, changes in business practices, and/or any other reason. The most recent version of this Agreement will be posted on the Website, and you should regularly check for the most current version. If the changes include material changes that affect your rights or obligations, we will notify you of the changes by reasonable means through the Website or via email. If you continue to use the Service after the changes become effective, you agree to the revised Agreement.
No failure by XPLAY to notify you of any breach or exercise of any rights shall be deemed a waiver thereof at the same or at any prior or subsequent time.
If any provision of these Terms of Use is deemed invalid and/or unenforceable under any statute, regulation, ordinance, legislation, or by an arbitrator or court of competent jurisdiction, then such provision shall be deemed reformed or deleted but only to the extent necessary to comply with such statute, regulation, ordinance, arbitrator, or court, and the remaining provisions shall remain in full force and effect.
XPLAY may assign, subcontract or otherwise transfer its rights and/or obligations hereunder without notice to you or obtaining your consent. You may not assign, sub-contract, or otherwise transfer your rights and/or obligations hereunder.
If you are a User in the European Union and your use of the Service is provided by CS Virtual Trade Ltd., these Terms of Use, their subject matter, formation, validity, interpretation, and enforcement, and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Cyprus.
If you are a User outside the European Union and your use of the Service is provided by G2G Marketplace Limited, these Terms of Use, their subject matter, formation, validity, interpretation, and enforcement, and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with the laws of Hong Kong.
Nothing in this article shall deprive a User acting as a consumer of any mandatory rights or protections granted by the laws of the country of that User's habitual residence which cannot be derogated from by agreement.
If you have any claim or dispute arising out of or in connection with the Service or these Terms of Use, you shall first send XPLAY a written notice describing the nature and basis of the claim or dispute and the remedy sought. The parties shall use reasonable efforts to resolve the claim or dispute amicably within 60 days after receipt of such notice.
If the claim or dispute is not resolved within such 60-day period, it may be submitted:
(a) in the case of Users contracting with CS Virtual Trade Ltd., to the courts of Cyprus; or
(b) in the case of Users contracting with G2G Marketplace Limited, to the courts of Hong Kong,
in each case unless otherwise required by mandatory applicable law of the country of the User's habitual residence. For the avoidance of doubt, nothing in this article limits any right of a consumer to bring proceedings before the courts of the country in which that consumer is habitually resident, where such right is mandatorily provided under applicable law.
Where permitted under applicable law, you agree to bring claims against XPLAY only in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.
